These Terms and Conditions exclude liability on behalf of K2 Cargo and its employees or agents for
loss, damage, and delay under certain conditions. Senders should review these conditions carefully
and obtain insurance coverage where necessary to protect their interests.
- Inspect your parcel upon receipt. Responsibility for the parcel transfers to you once it is
received.
- Parcels containing unauthorised items may be disposed of without prior notice.
- Refunds will only be issued upon presentation of proof of purchase.
- If a parcel has not been received in Pakistan and no enquiry has been made within 10 weeks, we
reserve the right to dispose of the parcel without notice.
- Delivery of parcels will take between 6 to 8 weeks; delays may occur if the customs office is
closed due to unforeseen circumstances.
- All deliveries are subject to customs clearance.
- Use of threats or abusive language will result in a denial of refund, and the parcel may be
disposed of without notice.
- We do not provide warranties against war conditions or natural disasters.
Our Obligations:
- K2 Cargo will endeavour to deliver the specified goods to the delivery address by the agreed
time or before.
- K2 Cargo will not be liable for any delays in delivery caused by the unavailability of the
consignee or other authorised recipients at the delivery address.
- K2 Cargo will not be liable for any loss, damage, misdelivery, or delayed delivery of goods
arising from:
- Acts of God, including but not limited to storms, tempests, or floods.
- Acts of war, hostilities, civil commotion, or the threat or fear of such conditions.
- Criminal, malicious, or negligent actions or omissions by third parties.
- Industrial action or unforeseen traffic conditions, including vehicle breakdowns.
- Effects of ionising radiation or uncontrolled nuclear reactions.
- Suspension or cancellation of transport services due to inclement weather or the threat thereof.
- Fire, lightning, or explosion.
- Seizure under legal process.
- Any act, default, or omission by the customer, their employees, agents, or any person with an
interest in the goods.
- Insufficient or improper packing, labelling, or addressing.
Your Obligations:
In accordance with the terms of this agreement, the customer agrees to the following conditions:
- The customer confirms that regarding the goods covered by this contract, they either have sole
beneficial ownership or possess the necessary authority from all relevant parties interested in
the goods to enter into and adhere to the terms of this contract.
- In the case of any third-party claims against the company that arise from this agreement, the
customer will indemnify the company. This includes covering all related legal fees and other
expenses. However, this indemnification excludes cases where it is proven that the couriers
would have been liable to the customer if the original claim had been directed against the
couriers, under the assumption that the customer retained ownership of the goods.
- The customer is required to promptly follow any instructions given by K2 Cargo, as stipulated in
the aforementioned clause, to ensure compliance with the terms of the agreement.
- The customer is obligated to make all payments due under this agreement in a timely manner.
By agreeing to these terms, the customer acknowledges their responsibilities and the protections
afforded to the company under this contract.
Limitation Of Liability:
- Should there occur an incident of loss, damage, or misdelivery of goods, where liability is not
already excluded, CARGO's financial responsibility shall be limited to the declared value of the
goods as specified by the customer, or as otherwise declared. This limit applies on a
proportional basis in cases where only part of the goods are affected. Furthermore, the cost of
repairing any damage or reconditioning the goods is covered, subject to a maximum compensation
of £150 per consignment, or part thereof, should only a portion of the consignment be
impacted.
- K2 Cargo shall not bear liability for any physical loss, misdelivery, or damage to goods that
are prone to theft unless there is a prior written agreement from K2 Cargo to transport such
items before transit begins. Additionally, the customer must agree in writing to cover all
additional costs, including insurance, which arise from transporting these specified items. This
exemption is applicable provided that the loss, misdelivery, or damage occurs during transit and
can be conclusively attributed to negligence on the part of the courier, its employees, or its
agents.
Excluded Goods:
- The customer is prohibited from submitting certain goods for carriage, and K2 Cargo reserves the
right to cease transport of such items at any time. The following items are strictly prohibited
from carriage:
- Explosive and flammable articles, firearms (including firearm components and ammunition), and
detonators.
- Goods classified as dangerous.
- Any items that are illegal to possess or import into any country that is part of the transport
route.
- Items prohibited as hand luggage by carriers such as British Airways or PIA.
- Materials that are obscene, blasphemous, scandalous, defamatory, or otherwise prohibited.
Transit Conditions:
- Transit may be halted due to unforeseeable circumstances.
- Loading and Unloading:
- During the collection or delivery of goods, either at the sender's or the consignee's premises,
K2 Cargo is not obligated to provide equipment, power, or labour assistance for the loading or
unloading process.
Dangerous Goods:
- K2 Cargo does not agree to transport or store goods that are hazardous, infested, contaminated,
or condemned.
Time Limits for Claims:
- Any goods that are damaged must be presented for inspection by K2 Cargo.
- K2 Cargo will not be held responsible for any loss, misdelivery, or damage unless the customer
provides written notification of the issue within 20 days from the start of transit.
Furthermore, any claims must be formally submitted in writing within 42 days of the commencement
of transit.
- The courier will be released from all liabilities concerning the shipment unless legal action is
initiated within 10 weeks from the end of transit. In cases of loss, misdelivery, or
non-delivery of the entire consignment, proceedings must commence within 20 days from the
detection of the issue.
- This contract and the accompanying terms and conditions are subject to and will be interpreted
according to the Laws of England.
